The contents present on Scarpato.it of which Scarpato srl is the author cannot be copied, reproduced, published or redistributed because they belong to the author himself. Copying and reproduction of the contents in any way or form is prohibited. The publication and redistribution of contents not expressly authorized by Scarpato srl is prohibited, as is the use of the brands present on the site (famous brands known to the public and users) in a manner that does not comply with the law.

GENERAL CONDITIONS OF USE

Use of the site is combined with acceptance of the general conditions of use, which are the only applicable ones and replace any other conditions, unless otherwise waived in writing. It is considered that, by confirming your order, the user has read and accepted these conditions without reservation. The user expressly agrees to comply with all the rules regulated by Italian law and subject to the jurisdiction of the Court of Verona. If you do not accept the conditions, please do not use the site. Scarpato srl reserves the right to modify these conditions at any time without notice, therefore the user is required to periodically check this page to check for any updates. Scarpato srl does not guarantee that its site is free of computer viruses or other components that could prove harmful, however it undertakes to ensure that the contents contained therein are safe and accurate. The methods of processing personal data (so-called privacy) are listed in the relevant section of the site and are to be considered an integral part of the contract.

CONDITIONS OF SALE

Scarpato srl sells, delivers and ships the items presented in the online catalog nationally and internationally through this site. The prices on the site are intended as public prices and therefore include VAT. The actual availability is to be considered linked to the goods actually in the store. Therefore, it reserves the right to cancel the order in particular cases such as (by way of example, but not limited to): warehouse errors, sudden unavailability of the product, typing errors. In the aforementioned cases it will be our responsibility to contact the buyer to offer alternatives or cancel the existing order. The correct receipt of the order is confirmed by Scarpato srl by means of a response via e-mail, sent to the e-mail address communicated by the user.  This confirmation message will contain the Date and Time of receipt of the order and an “Order Number”, to be used in any further communication with Scarpato srl. The message presents all the data entered by the user who undertakes to verify its correctness and to promptly communicate any corrections. The user can also check the status of his order by accessing the web area dedicated to him. Cancellation of the order can be requested as long as it is not yet being prepared in the warehouse. The status of the order is visible in the appropriate section of the site. The order can no longer be canceled once the indication “Order in Process” appears. The purchased products must be paid for at the same time as the purchase transaction is closed by:

• CREDIT CARD
• The amount relating to the processed goods is charged to the user’s credit card at the time the order is acquired. The accepted credit cards are all those that rely on the Visa, Mastercard and American Express circuits. Under no circumstances will Scarpato srl ever have access to financial information such as credit card number, expiry date, etc.
• BANK TRANSFER
• In case of payment by advance bank transfer, the order will be sent only upon actual crediting to Scarpato Srl’s current account, which must take place within 5 working days from the date of acceptance of the order, after which the order is automatically considered cancelled. The reason for the bank transfer must include the order identifier which is released in the order confirmation email. The bank details to which to make the transfers are shown in the order confirmation email.

By sending the order, the user unconditionally accepts all the provisions contained in the conditions of sale as well as the further information contained in the web pages of the site referred to and/or linked here.

DELIVERY CONDITIONS

The goods travel on behalf and at the risk of the buyer: Scarpato srl will therefore not be responsible for any delays or damage resulting from transport. If the package arrives visibly damaged, collect the package by signing with reserve, otherwise it will not be possible to request a refund. In the event of a package rejection, Scarpato srl can request the customer to pay the entire amount of shipping costs and the cost incurred for returning the package to the sender. The delivery terms indicated by Scarpato srl refer to the products in stock and are to be considered non-binding given that they can be modified by Scarpato srl in case of actual needs. Scarpato srl reserves the right to deliver the products relating to the same order in multiple deliveries without further charges to the customer.  Specific delivery conditions and terms must be agreed in advance via email or telephone between the Customer and Scarpato.it and accepted by both parties. Any special offers or promotions proposed by Scarpato srl are valid until they expire or until the products covered by the promotion are sold out.

SHIPPING METHOD

The items will be processed in the shortest possible time subject to availability of the items themselves and authorization of payment according to the methods expressed previously. That is, crediting the bank transfer to our bank. c/c at our. bank (bank transfer payment), payment confirmation notification (credit card, Paypal or cash on delivery) Shipping costs can be verified once the shopping cart on our portal has been loaded. Costs vary depending on the number of products purchased. Any local, import and/or customs clearance taxes remain the responsibility of the customer.

RIGHT OF WITHDRAWAL

The right of withdrawal can be exercised within 14 days from the date of receipt of the goods by sending a registered letter with return receipt to the address: Via Olmetto, 27, Villa Bartolomea VR, Italy. The withdrawal period expires 14 days after the day on which the customer or a third person acquires physical possession of the product. The right of withdrawal also does not apply to sealed products opened by the consumer nor to the supply of goods made to measure or clearly personalized or which, by their nature, cannot be returned or risk deteriorating or altering rapidly. This right lapses in the presence of a damaged product, in the absence of the original packaging and/or integral parts of the product. The costs for returning the goods will be borne by the customer, the refund of the order will take place within 30 days of receipt of the goods by ordinary bank transfer. COMPLAINTS Complaints and disputes can only concern imperfections or discrepancies in customizations. For any complaints, Customers can call 0442.637311 or write an email containing the details of the complaint to qualitative@scarpato.it, no later than 8 days from receipt of the goods. Complaints made in ways other than those specifically provided for will not be considered valid by the Seller. FINAL PROVISIONS AND JURISDICTION Any dispute in any way connected to these general conditions will be referred to the exclusive jurisdiction of the Court of Verona. Any and all agreements in contrast with the above provisions will be valid only if formulated in writing and specifically signed by both parties.
